Terms & Conditions

These Terms & Conditions define the rules for using the Peko Peko Box Online Store, including online contracts, subscription rules, payments, delivery, complaints, cancellations, and basic information regarding customs duties and taxes. Acceptance of these Terms & Conditions is required to place an order.

§1. General Provisions

Peko Peko Box (the “Online Store”) offers a product consisting of a box with Japanese sweets and snacks, available in the following purchase options:

  • One-time purchase
  • 3-month subscription plan with a one-time payment
  • 6-month subscription plan with a one-time payment
  • 12-month subscription plan with a one-time payment

Boxes are shipped within up to 5 business days after the order is placed. In each subsequent month, the box is shipped around the same day of the month on which the original order was placed.

The contents of each box are matched to the theme of a given month. Box themes and contents change monthly. The contents of the box are determined by the theme valid at the time of purchase. The monthly theme changes on the first business day of each month, according to the JST timezone.

§2. Definitions

  • Customer – a natural person (consumer), legal entity, or organizational unit placing an order in the Store.
  • Store – the sales service available at the address indicated on the Store’s main page, offering subscription boxes with sweets.
  • Product / Box – a box containing Japanese sweets and snacks, the contents of which are a surprise and depend on the monthly theme.
  • Order – a declaration of intent by the Customer to conclude a sales or subscription agreement for a Box.
  • Subscription / Plan – a recurring box delivery service paid for with a single upfront payment.

§3. Use of the Store

The Store may be used by adults or by minors under the supervision and consent of a legal guardian.

The Customer agrees to:

  • Provide true and up-to-date information, including a full legal name consistent with identity documents and a correct delivery address,
  • Comply with these Terms & Conditions.

§4. Product and Subscription Plans

The Store offers one type of product: a box with Japanese sweets and snacks. Payment for each plan is collected as a single upfront payment at the time of placing the order.

The 3-, 6-, and 12-month plans offer a lower monthly price compared to a one-time purchase. The subscription remains valid until it is completed or canceled by the Customer in accordance with §7.

The contents of the Box are a surprise. The number and type of products may vary between months and editions. The Store does not guarantee the inclusion of any specific brands, flavors, or products.

Photos and descriptions displayed on the website (including spoilers, promotional graphics, and example contents) are for illustrative purposes only. Actual box contents may differ due to product availability, logistics, recipe changes, or customs requirements.

§5. Allergens, Ingredients, and Food Safety

Boxes may contain products with allergens, including but not limited to: gluten, soy, milk, eggs, nuts (including peanuts), sesame, fish, shellfish, seafood, and other ingredients typical of processed foods.

  • The Store cannot guarantee that any box is free from allergens.
  • The product is not suitable for individuals with severe food allergies.
  • The Store is not responsible for allergic reactions or health issues resulting from the consumption of the products.

§6. Placing Orders

Orders may only be placed via the order form available on the Store’s website. The Customer selects a plan (or a one-time Box), adds it to their cart, provides delivery details, selects a payment method, and confirms their order.

Order fulfillment requires:

  • Correct completion of the order form,
  • Acceptance of the Terms & Conditions,
  • Successful payment.

After placing an order, the Customer receives an email confirmation.

Box Themes & Monthly Changeover
Boxes purchased on the last day of a month are assigned to the theme valid on the purchase date.
Example: a January box purchased on January 31 will be shipped on the first business day of February, but it will still be a January box.
The box theme changes on the first business day of each month.
If an order is placed around the turn of the month, the purchase date determines the box theme.

§7. Subscription, Renewals, and Cancellation

Purchasing a 3-, 6-, or 12-month plan constitutes a subscription agreement with a one-time payment covering the entire subscription period and shipping.

Shipping timing and billing cycle

  • Boxes are shipped within up to 5 business days after the order is placed.
  • In each subsequent month, the box is shipped around the same day of the month on which the original order was placed.

Subscription cancellation

  • The Customer may cancel a subscription plan at any time by contacting Store support.
  • Cancellation does not result in any refund, including for undelivered boxes or shipping costs.
  • One-time boxes cannot be canceled. Customers are encouraged to make thoughtful purchases.
  • A one-time purchase is not a subscription and expires automatically once the Box has been shipped and delivered.

§8. Prices and Payments

  • All prices are listed in EURO and cover the product only.
  • Prices do not include customs duties, import taxes, or other charges imposed in the destination country.
  • Available payment methods (e.g., card, PayPal, other online methods) are displayed on the Store website during checkout.
  • Cash on Delivery (COD) is not available. All orders must be prepaid.
  • The Store reserves the right to change subscription prices; such changes do not affect payments already made.

§9. Delivery, Costs, and Restrictions

Delivery method: all shipments are sent via AIR MAIL from Japan (Japan Post) and then handed over to the official postal operator in the destination country. Shipping methods may change in the future.

Estimated delivery times depend on the destination country and may range from approximately one to several weeks. These timeframes are estimates and may be extended due to holidays, air traffic disruptions, or extraordinary circumstances.

  • After shipment, the Customer receives a tracking number.
  • The Customer is obligated to independently monitor the shipment tracking status.
  • The Store is not responsible for missing delivery notifications or lack of collection information; responsibility lies with the local delivery provider in the destination country.
  • No compensation or reimbursement will be provided if a package is returned due to tracking updates not being monitored or updated.

The Store has no control over:

  • Local sorting and delivery procedures,
  • Tracking update frequency,
  • Decisions and actions of foreign postal operators,
  • Delays caused by customs clearance.

Customs duties, import taxes, and other fees imposed by customs authorities or postal operators in the destination country are borne by the Customer. Failure to pay such charges may result in the return or destruction of the shipment in accordance with local regulations.

If a shipment is returned to the sender for reasons beyond the Store’s control (e.g., uncollected shipment, incorrect address, refusal of delivery), the Store may offer reshipment upon payment of an additional shipping fee.

§10. Returns

Due to the international nature of sales, the nature of the product (food), and the surprise box format, returns after shipment are generally not possible.

Exceptions apply only if:

  • An obvious error occurred on the part of the Store,
  • The box arrived in a condition preventing consumption (e.g., severe damage).

In such cases, the Customer must contact the Store immediately, no later than 7 days after delivery, providing:

  • Order number,
  • Photos of the outer packaging and contents,
  • A description of the issue.

If delivery issues arise due to the delivery provider and not the Customer, the Store may offer: shipment of a replacement box, a partial refund, or another individual solution.

No compensation or reimbursement is available if a package is returned due to failure to track the shipment or collect it in time. Tracking updates, frequency, and level of detail may vary by destination country.

§11. Intellectual Property

All content available in the Store (texts, graphics, images, logos, page layout) is the property of the Store and is legally protected.

Copying, reproducing, modifying, or using such content for commercial purposes without prior written consent is prohibited.

§12. Personal Data

The Store operator is the controller of Customers’ personal data.

Personal data is processed for the purpose of:

  • Order and subscription fulfillment,
  • Payment processing,
  • Handling returns and complaints,
  • Sending marketing communications (with consent),
  • Fulfilling legal obligations.

Data may be shared with payment processors and carriers to the extent necessary to fulfill the order.

§13. Amendments to the Terms

The Store may amend these Terms & Conditions for valid reasons (e.g., changes in law, offer, payment methods, or delivery methods). Changes will be announced by publishing an updated version on the Store website.

Orders and subscriptions placed before the effective date of changes have a Grandfather Clause and are therefore governed by the version of the Terms in force at the time of purchase.

§14. Governing Law and Disputes

Agreements concluded through the Store are governed by the law of the country in which the Store operator is registered (Japan).

Any disputes arising between the Customer and the Store may be resolved through:

  • Negotiations, or
  • The court competent for the Seller’s registered office.
